Every person who receives care through In Home WellCare has rights protected by Rhode Island law and upheld by our CHAP-accredited standards of excellence. We believe informed clients receive better care. This page outlines what you are entitled to, what we commit to, and how we work together to keep your care safe, consistent, and compassionate.

Your Rights as a Client
These rights are guaranteed under Rhode Island General Laws § 23-17.16-5 and reinforced through our CHAP accreditation.
Right to Equal Treatment
You have the right to receive services without regard to race, creed, color, gender, sexual orientation, age, disability, or source of payment. Every client receives the same standard of care.
Right to Safe, Dignified Care
You have the right to receive safe, appropriate, and high-quality care delivered in a timely manner with consideration, dignity, respect, and privacy.
Right to Accept or Refuse Care
You have the right to accept or refuse any care or service, and to be informed of the consequences of that decision. Your choices will always be respected.
Right to Be Free From Abuse and Neglect
You have the right to be free from mental or physical abuse, physical punishment, neglect, damage to or theft of property, and exploitation of any kind. This is non-negotiable.
Right to Have Your Property Respected
Your home is your space. Every caregiver who enters your home will treat your belongings and your environment with care and respect.
Right to Exercise Your Rights
You have the right to exercise any of the rights listed on this page without fear of retaliation or discrimination. If you are unable to exercise your rights, a family member, agent, or legal guardian may do so on your behalf.
Right to Be Informed About Your Care
You have the right to be informed in advance about the care to be provided, the plan of care, and any changes to your services before those changes are made.
Right to Participate in Your Care Plan
You have the right to help plan the care and services you receive, and to request changes to your care plan at any time.
Right to Know Your Care Team
You have the right to be advised in advance of the disciplines that will provide your care, the frequency of visits, and the names and qualifications of every individual assigned to your case.
Right to Access Your Records
You have the right to receive information necessary to make decisions about your care, and to have access to your own records. If appropriate, a family member may receive this information on your behalf.
Right to Confidentiality
You have the right to confidentiality regarding your care, treatment, and all information contained in your records. Information will only be shared as required by law or with your written consent.
Right to Voice Complaints
You have the right to voice complaints or concerns about the care you receive, or about any failure to respect your rights, without fear of retaliation. Every complaint will be documented and investigated, and you will be informed of the resolution.
Right to Know About Costs
You have the right to be advised, before care begins, whether your provider participates in your healthcare plan, the cost of services, the extent to which payment may come from insurance or government sources, and any charges you may be responsible for.
Right to Know About Billing
You have the right to be informed of our billing procedures and your payment responsibilities, if any, before services begin.
Right to Know Who Owns the Agency
You have the right to be informed of the ownership and control of In Home WellCare. We are a family-owned, Rhode Island-based home care agency. Our leadership team and ownership information is available on our Leadership page.
Right to Refuse Research or Experimental Activities
You have the right to be informed of any experimental research or investigational activities, and to refuse to participate.
Right to Be Told About Other Healthcare Options
You have the right to be informed about other healthcare services and community resources available to you, including hospice care.
Right to Appeal Decisions
You have the right to be informed, in writing, of your right to appeal any determination made by In Home WellCare regarding your eligibility for service, the types or levels of service in your care plan, or any termination or change in service.
Right to Know Where to File Complaints
You have the right to be advised, in writing, of the names, addresses, and telephone numbers of the Rhode Island state ombudsperson, the Attorney General's Medicaid Fraud Control Unit, the Rhode Island Department of Health, and the state toll-free home health hotline.
Your Responsibilities as a Client
Great care is a partnership. When you do your part, we can do ours at the highest level.
Provide Accurate Information
Please give us complete and accurate information about your health condition, medications, allergies, and any changes in your status. The more we know, the better we can care for you.
Follow Your Care Plan
We develop your care plan based on your needs and your input. Following the agreed-upon plan helps your caregiver deliver consistent, effective services. If something in your plan is not working, let us know so we can adjust it together.
Treat Your Caregiver With Respect
Our caregivers are trained professionals who are there to help you. We expect that clients and household members treat caregivers with the same dignity and respect that we require our caregivers to show you.
Maintain a Safe Home Environment
Please ensure your home is reasonably safe for your caregiver to work in. This includes keeping walkways clear, securing pets during visits, and informing us of any safety concerns such as broken equipment, pest issues, or environmental hazards.
Be Available for Scheduled Visits
Your caregiver is scheduled based on your care plan. Please be home and available for your scheduled visits. If you need to cancel or reschedule, contact our office as soon as possible at (401) 402-0076 so we can adjust the schedule and avoid disruptions to your care.
Communicate Concerns Promptly
If you have a concern about your caregiver, your schedule, or any aspect of your care, please tell us right away. We cannot fix what we do not know about. You can reach us by phone, email, or through your coordinator.
Notify Us of Changes
Please inform us promptly if there are changes to your insurance, Medicaid eligibility, contact information, emergency contacts, or living situation. Keeping your information current helps us maintain uninterrupted service.
Respect Medicaid and Agency Policies
Rhode Island Medicaid has specific rules that govern how home care services are provided. These include requirements about who can serve as your caregiver, how visits are documented, and how services are billed. We ask that you cooperate with these requirements, which exist to protect both you and the integrity of your care.

We take every concern seriously. If you feel your rights have not been respected or you are dissatisfied with any aspect of your care, here is what to do.
Tell Us Directly
Call our office at (401) 402-0076 during business hours (Monday through Friday, 9:00 AM to 5:00 PM). Ask to speak with Kilvia, our Compliance Officer, or your care coordinator. We will listen, document your concern, and take immediate action to resolve it. This is always your first step.
We Investigate & Resolve
Every complaint is taken seriously. Our compliance team will investigate thoroughly, keep you informed of our findings, and work with you to resolve the issue. Most concerns are resolved directly between our team and you.
External Appeals (If Needed)
If you feel your concern was not adequately addressed, you have the right to contact state agencies. However, we encourage you to work with us first—we want the opportunity to make it right.
